Name of the register

Customer register of Etola AB (Hereinafter Etra).

Purpose of use for the data

The purpose of use for this register is customer relationship management, maintaining customer register, communication, marketing, and managing and archiving customer orders. The Customer has a right to opt out of receiving any direct marketing.

The Customer has a right to check, amend, and remove any information on themselves in the register. The customer information in the register will not be disclosed to third parties. The information is managed within the constraints of the Finnish Personal Data Act.

Description of the entities in the register

The register contains information on companies and persons who have registered as a customer in Etra webshop.

Description of information related to registered entities

The information saved in the register consists of information entered by the users at the time of registration as a customer in Etra, or information entered by Etra with a consent from the customer.

The register contains e.g. the following information: name of the company, address, business ID, telephone number, and the name and e-mail address of a contact person.

Confidentiality and security of the register

The customer register is confidential, and it is duly protected from third parties. The IT system is physically located in a location, where unauthorized third parties do not have access to the information. The system is protected with a firewall. The information is secured against malfunctions with a backup.

The register is accessed only by limited personnel with proper authorization. The right to use the register is granted and managed by a team lead by Tony Sandberg. The personnel using the information in the register at Etra are bound by confidentiality. The information is disclosed to third parties only on the customer’s own request, or to officials due to obligation to report based on legislation.

General Terms of Sale and Use of Etra Webshop

1. Application

The general terms of sale and use of the webshop are applied to online commerce between Etra (Hereinafter ’Etra’) and a corporate customer (hereinafter ‘Customer’), unless mutually otherwise agreed. Etra has a right to amend these terms. The valid terms are available in Etra online location www.etra.se.

2. Contact persons and users

The Customer provides Etra with information on the contact persons, and Etra delivers the required user identifications and passwords to the contact persons. An existing Etra credit account relationship or approved quick registration is a prerequisite for acquiring access to the webshop. 

The Customer may create user IDs for their personnel (’User’) in Etra webshop (‘Service’). These persons are authorized to make purchases in Etra webshop. The Customer agrees to keep the user IDs and passwords for the members of their personnel up to date, and to deactivate user IDs for persons who are no longer authorized to make purchases. The Customer provides the contact persons information and notifies Etra in writing about changes in the contact information using the e-mail address [email protected] before the changes are enforced.

Customer agrees to protect the passwords they are using and agrees that they are responsible for all orders placed using the user IDs issued to them. The customer is responsible for ensuring that only authorized personnel use the issued user IDs in Etra webshop. The user IDs and passwords used in Etra webshop must not be used in other services. The customer is responsible for making sure that the authorized personnel have adequate knowledge on the contractual terms of the webshop.

The commerce in Etra webshop always takes place between Etra and the customer company, unless otherwise agreed in writing. The Finnish Consumer Protection Act is not applied to commerce between companies in Etra webshop.

The Customer must confirm that they represent the company in question and that they agree to the terms that the commerce in Etra webshop takes place between companies per to the terms described in General Terms of Sale and Use of Etra Webshop

3. Order, delivery, and payment

An order made by the Customer is binding once is has been saved on the webshop’s server. Changes and cancellations on binding orders can only be made by Etra. The terms of delivery and payment and the price list for Etra’s services valid during the time the order was placed will be applied to the webshop order. The valid prices are available in the webshop and will be confirmed on an order confirmation delivered by Etra once the order has been confirmed. The webshop commerce between Etra and the Customer is subject to the customer’s credit limit defined in the account contract.

4. Limitations of use

The Customer and/or User do not have a right to:

(i) copy, present, relay in public, send forward or otherwise use any part or content of the Service in any way that is not expressly allowed in these terms of use;

(ii) sell or try to sell the right to use the service or information required to access the Service;

(iii) disclose the passwords to third parties, or use a user ID or password without required authorization;

(iv) reverse engineer, transcribe, change, or use the Service or any part thereof to create imitative services;

(v) circumvent any safety measures used to secure the Service created or licensed by Etra;

(vi) hire or lease the Service or any part thereof;

(vii) use the Service in any way that is in breach of these terms;

(viii) artificially speculate the limits regarding pricing, or manipulate the Service in any way; or

(ix) use the service for illegal intentions or contrary to good practice, or to harm, destroy, or overload the service in any way.

In addition to the above, the Customer and the Customer’s users agree to ascertain within reason that the Service or its contents are not used without authorization.

Etra reserves the right to unilaterally discontinue the Service and revoke the Service from a Customer or a User at any time, if the Customer or someone else using their user ID is suspected to use the Service against these terms or otherwise in abusive manner, or in the event that Etra in their own discretion views the use of the Service to be against good practices or against Etra’s interests. If Etra revokes the service for other reasons than those mentioned here, Etra is not responsible for the Customer, the Customer’s User, or a third party, and Etra is not obligated to reimburse the payments that may have been made.

5. Processing of personal and other information

Etra collects and saves the information on the User that is entered upon registration, while placing orders and using the Service. Additionally, Etra collects information about the use of the Service and the interaction between Etra and the Customer and/or the User. The collected information includes personal information. The User expressly gives consent that Etra may collect and manage personal information according to the valid Privacy Policy of Etra Customer and Marketing Register. The valid privacy policies are available in Etra’s website Etra Oy - Sekretess för data (e-business.fi)

Etra or third parties may use cookies, trackers, and other analysis technology to collect, use, record, and transmit technical and other information. Cookies, trackers, and other analysis technologies are not used to collect information on the User that can be used to identify the User. Information collected by using cookies, trackers, and other analysis technologies may be used for e.g. development of the service. 6. Intellectual property rights

All intellectual property rights to the content of the webshop belong to Etra or their licensor.

7. Liability and restriction of liability

In all possible events, the maximum amount of Etra’s liability is limited to the price the Customer paid for the product(s) that directly caused the damage, or that was directly related to the damage.

Etra or the Customer are not responsible for damage caused directly or indirectly to a third party unless the damage was caused intentionally or due to gross negligence. The user register of Etra webshop is confidential; the information is not disclosed to third parties without a consent from the other party unless legislation or official regulation requires otherwise.

If Etra or their employees or representatives are deemed responsible for the insufficient, inadequate, or obsolete information or any other similar inaccurate information in the chemical management system existing in conjunction with Etra webshop, the Customer using the chemical management system agrees to reimburse the possible costs and damages that they would suffer or would have to reimburse in full to Etra or their employee/representative.

The Customer is responsible for acquiring backups of their information and files. Etra is not responsible for the destruction, loss, or alteration of information or files, or any damages or costs thereof.

8. Other terms
